Terms of use

These terms govern your use of IsleList, operated by Manx Digital from Central Promenade, Douglas, Isle of Man, IM2 4JL. For questions about these terms, contact support@islelist.com.

About IsleList and Manx Digital

IsleList is a marketplace service operated by Manx Digital under the IsleList brand.

References to "IsleList", "we", "us", and "our" in these terms mean IsleList by Manx Digital.

About these terms

These Terms of Use constitute a legally binding agreement between you and IsleList ("we", "us", "our") governing your use of the IsleList platform.

By creating an account or using our services, you confirm that you accept these terms and agree to comply with them.

If you do not agree to these terms, you must not use our platform.

These terms are governed by the laws of England and Wales. Users in the Isle of Man are also subject to applicable Manx law where relevant.

Platform role and scope

IsleList provides listing, profile, and messaging surfaces that help local buyers and sellers find each other.

Many transactions, payment, collection, and handover happen directly between users offline. Eligible Buy Now listings can also send buyers to PayPal using the seller's registered IsleList email, but IsleList does not inspect items, hold funds, or guarantee transactions.

We provide the platform for connecting buyers and sellers but are not party to any agreements made between users.

IsleList is not responsible for the quality, safety, legality, or accuracy of listings, items, or user conduct during offline transactions or post-checkout handover.

We operate as an information society service provider and our liability is limited as set out in these terms and applicable law.

Account requirements

You must be at least 18 years old to create an account and use IsleList services.

You are responsible for maintaining the security of your account credentials and all activities under your account.

One person may only maintain one active account. Creating multiple accounts to evade bans or manipulate the platform is prohibited.

You must provide accurate information during registration and keep your account details up to date.

User responsibilities

Users are responsible for creating accurate listings with truthful descriptions, fair pricing, and appropriate categorization.

All items listed must be legal to sell in your jurisdiction and comply with local laws and regulations.

You must honor accepted offers and communicate clearly if circumstances change.

Users are responsible for their own safety during meetups, inspections, and payment exchanges.

You agree to follow our community guidelines and safety recommendations at all times.

Prohibited conduct

Spam, duplicate listings, fraudulent activity, misleading descriptions, and price manipulation are strictly prohibited.

Harassment, threats, discriminatory language, or abusive behavior toward other users will not be tolerated.

You may not list stolen goods, counterfeit items, illegal substances, weapons, adult content, or items that violate local laws.

Attempting to circumvent platform fees, manipulate feedback, or abuse reporting systems is prohibited.

Listings and content

You retain ownership of content you post but grant IsleList a license to display, store, and distribute it as needed to operate the platform.

You are responsible for ensuring you have the right to sell items and use any photos or content in your listings.

IsleList reserves the right to remove listings that violate our policies or applicable laws without prior notice.

Inactive or expired listings may be archived or removed according to our retention policies.

Offers and transactions

Offer threads are negotiation tools. Sellers may accept, decline, or counter offers at their discretion.

Accepting an offer creates an agreement between buyer and seller. IsleList is not party to this agreement.

Feedback is reserved for completed sales through the accepted-offer flow and should reflect actual transaction outcomes.

Disputes between buyers and sellers should be resolved directly. IsleList may provide moderation support but does not arbitrate disputes.

Fees and subscriptions

Pro and Business+ subscriptions are billed through Stripe on a recurring basis until cancelled.

Eligible paid-tier listings may also use PayPal for Buy Now payments sent to the seller's registered IsleList email.

Eligible accepted offers may also use PayPal when online payment is available for that sale.

All fees are non-refundable except where required by law or at IsleList's sole discretion.

You are responsible for any taxes applicable to your transactions or subscription fees.

Moderation and enforcement

IsleList reserves the right to review, moderate, and remove content that violates our policies.

Accounts may be warned, restricted, or permanently banned for policy violations, fraud, or abusive conduct.

We review moderation decisions with full context but are not obligated to provide detailed explanations for enforcement actions.

Repeated violations or serious misconduct may result in immediate account termination without prior warning.

Consumer rights (UK)

If you are a consumer in the UK, you have legal rights under the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013.

For Pro and Business+ subscriptions, you have a 14-day cooling-off period from the date of purchase during which you may cancel for a full refund if you have not used the service.

Once you begin using paid-tier features, you acknowledge that the service has commenced and waive your right to cancel for a refund.

Nothing in these terms affects your statutory rights as a consumer, including rights relating to faulty digital content or services not provided with reasonable care and skill.

These terms do not apply to peer-to-peer transactions between users. Your consumer rights in relation to items purchased from other users are governed by your agreement with the seller.

Limitation of liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

Subject to the above, we are not liable for any loss or damage arising from your use of the platform, transactions with other users, or content posted by users.

We are not liable for business losses. If you use IsleList for commercial purposes, we are not liable for loss of profits, sales, business, or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill, or reputation; or any indirect or consequential loss.

Our total liability for any claims related to the service is limited to the greater of £100 or the amount you paid us in the 12 months before the event giving rise to the claim.

We are not responsible for losses that were not foreseeable to both you and us when you started using our services.

Dispute resolution

If you have a complaint about our services, please email support@islelist.com. We will try to resolve the issue informally.

UK and EU consumers may be able to use the Online Dispute Resolution platform provided by the European Commission, though this may not be available post-Brexit.

If we cannot resolve a dispute informally, you may refer the matter to the courts as set out in the governing law section below.

Nothing in these terms affects your right to take legal action in the courts.

Governing law and jurisdiction

These terms are governed by the laws of England and Wales.

For users resident in the Isle of Man, these terms are also subject to applicable Manx law, including the Sale of Goods Act 1896 and Consumer Protection Act 1991 (as amended).

If you are a consumer, you may bring legal proceedings in respect of these terms in either the English courts or the courts of the country in which you live.

If you are a business user, any disputes must be resolved in the courts of England and Wales.

For Isle of Man residents, proceedings may also be brought in the Isle of Man courts where appropriate under Manx law.

Changes to terms

We may update these terms from time to time to reflect changes in our services, legal requirements, or business practices.

We will notify you of significant changes by email (where we have your email address) or by posting a notice on the platform at least 30 days before the changes take effect.

If you do not agree to the changes, you must stop using our services before the changes take effect.

Continued use of IsleList after the effective date of changes constitutes acceptance of the updated terms.

You are responsible for reviewing the terms periodically to stay informed of any updates.

General provisions

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these terms will not be deemed a waiver of such right or provision.

These terms constitute the entire agreement between you and IsleList regarding use of the platform.

You may not assign or transfer these terms or your account to anyone else without our written consent.

We may assign or transfer our rights and obligations under these terms to another organization, but this will not affect your rights or our obligations under these terms.
